HOW TO REGISTER FOR THE EXAM

The USPTO outlines all the infomation about applying for the Patent Bar Exam in the General Requirements Bulletin (GRB Bulletin).  This "bulletin" is a long and comprehensive document that at times can be confusing.  While we suggest you take a look at the GRB for yourself, we've attempted to streamline and clarify the requirements for you below by breaking out each section and giving you an overview of SPECIFICALLY what you'll need to include.

*REMEMBER: there are time constraints upon registering to take the exam!*


WHAT IS NEEDED TO REGISTER FOR THE EXAM?

You'll need to gather a number of documents before you can send in your application.  Yes, this seems very obvious, but, please make note:

YOU do NOT want to miss any of the little details when sending in your application (especially if you are in a crunch for time!).

A COMPLETED APPLICATION INCLUDES:

  • Application Fee

EITHER...

$40.00 non-refundable application fee as required by 37 CFR § 1.21(a)(1)(i)  (this is the fee most of you will be required to pay)

OR

$1600.00 non-refundable fee if required pursuant to 37 CFR § 1.21(a)(10);

(This fee is for a person for recognition or registration after disbarment or suspension on ethical grounds, or resignation pending disciplinary proceedings in any other jurisdiction; on application by a person for recognition or registration who is asserting rehabilitation from prior conduct that resulted in an adverse decision in the Office regarding the person's moral character; and on application by a person for recognition or registration after being convicted of a felony or crime involving moral turpitude or breach of fiduciary duty; on petition for reinstatement by a person excluded or suspended on ethical grounds, or excluded on consent from practice before the Office)

  • Examination Registration Fee

EITHER...

$200.00 registration examination fee to the United States Patent and Trademark Office for test administration by a commercial entity. [37 CFR § 1.21(a)(1)(ii)(A)]   (** This is the fee you must pay if you are taking the test at a Prometric Testing Center**)

OR

$450.00 registration examination fee to the United States Patent and Trademark Office for test administration by the USPTO. [37 CFR § 1.21(a)(1)(ii)(B)] (This is the fee if you are having the USPTO administer the exam…for example, if you are taking the paper based exam).

  • Official transcripts;

We advise that you have the transcripts sent to you directly, and that you include them in your application mailing.

  • Course descriptions (Category B Applicants only)
     
  • Any other required documentation (for example, information upon which applicant relies to demonstrate qualifications to sit for the examination, evidence of permanent residence, or documents required in response to questions 15 through 22); An alien must provide a copy of all documents submitted to and received from the USCIS.?

Remember, you’ll need to pay both an application and exam registration fee. For pretty much most of you, that will be $40 (application fee) and $200 (Registration Fee) for a total of $240.

On the form, under "Other Fee," write "Application and Registration Examination Fees."

This certificate must be in the envelope with the material and/or documents mailed!  Don't forget this!
